Terms & Conditions

These terms set out the conditions that apply when you engage with Kinwise — whether you are visiting our website, making an enquiry, or enrolling in one of our educational programmes. Please read them carefully.

1. Definitions

Throughout these Terms, the following words have the meanings given below:

Kinwise / We / Us / Our
The business operating as Kinwise, registered at 18 Persiaran Bukit Tunku, 50480 Kuala Lumpur, Malaysia.
You / Participant
Any person who visits our website, submits an enquiry, or enrols in a Kinwise programme.
Services / Programmes
The educational courses, workshops, and retreats offered by Kinwise as described on this website.
Site
The website located at kinwisem.info.
Agreement
These Terms & Conditions, together with our Privacy Policy and any booking confirmation, constitute the agreement between you and Kinwise.

2. Acceptance of Terms

By accessing the Site, submitting an enquiry, or enrolling in a Kinwise programme, you confirm that you:

  • are aged 18 or over and have the legal capacity to enter into a binding agreement;
  • have read and understood these Terms;
  • agree to be bound by them in respect of your use of the Site and any programme enrolment.

If you do not agree with these Terms, please refrain from using the Site or enrolling in our programmes.

3. Description of Services

Kinwise offers the following educational programmes to adults in Malaysia:

Co-Parenting Communication Course

RM 860

A six-session evening course for adults seeking a structured framework for routine co-parenting conversations. Sessions are educational in nature and do not constitute counselling, mediation, or professional advice.

Family Records and Inventory Workshop

RM 520

A half-day organisational workshop for households organising shared administrative records. The facilitator provides templates and guidance on sorting; no advice on document content is offered.

Family Conversation Retreat

RM 3,950

A two-day facilitated retreat for family groups, held outside Kuala Lumpur. Meals and accommodation are included. The facilitator does not provide counselling, mediation, or any regulated service.

Kinwise reserves the right to adjust programme formats, dates, and venues with reasonable notice. In the event of a material change, enrolled participants will be informed and offered alternatives.

4. Your Responsibilities

When using the Site or attending a programme, you agree to:

  • provide accurate and current information when making an enquiry or booking;
  • engage respectfully with facilitators and other participants;
  • not record, photograph, or share session content without express written consent;
  • not use the Site to transmit any material that is unlawful, offensive, or disruptive;
  • comply with any programme-specific conduct guidelines provided at enrolment.

Kinwise reserves the right to decline or remove a participant from a programme if their conduct is inconsistent with these expectations, at our sole discretion.

5. Intellectual Property

All content on the Kinwise website — including text, design, workbooks, templates, and programme materials — is the intellectual property of Kinwise or its content providers and is protected under Malaysian copyright law.

You are granted a limited, personal, non-transferable licence to access the Site and use materials provided during a programme for your own personal, non-commercial purposes. You may not:

  • reproduce, copy, or distribute programme materials without written permission;
  • use Kinwise materials for commercial or training purposes;
  • remove any copyright or attribution notices from materials.

6. Payment and Refund Policy

Payment

All fees are quoted and payable in Malaysian Ringgit (RM). Payment arrangements and accepted methods will be confirmed at the time of booking. A place on a programme is confirmed once payment has been received.

Cancellation by Kinwise

If Kinwise cancels a programme, enrolled participants will receive a full refund or the option to transfer to an alternative date. We are not liable for additional costs you may incur (such as travel arrangements) as a result of a cancellation.

7. Programme-Specific Terms

Enrolment

Enrolment is confirmed upon receipt of payment and a booking confirmation from Kinwise. Places are limited and allocated on a first-come basis.

Attendance

Participants are encouraged to attend all sessions of a course. Kinwise cannot accommodate make-up sessions for individual missed sessions unless specifically noted in the programme description.

Workbooks and materials

Printed workbooks and templates distributed during programmes are for participants' personal use only. They are not transferable and may not be reproduced commercially.

Retreat accommodation

For the Family Conversation Retreat, accommodation is included as described. Kinwise will communicate venue details and arrival information to enrolled participants in advance. Participants are responsible for their own travel to and from the venue.

Important notice

Kinwise programmes are educational and organisational in nature. They are not a substitute for counselling, legal advice, mediation, or any service that requires a regulated professional qualification. Nothing said or written by a Kinwise facilitator should be understood as professional advice of any kind.

8. Disclaimers

The Kinwise website and its content are provided in good faith for informational and educational purposes. To the extent permitted by Malaysian law:

  • Kinwise makes no representation that the Site will be uninterrupted, error-free, or free of harmful components.
  • Information on the Site is provided for general educational purposes and does not constitute professional, legal, financial, or therapeutic advice.
  • Kinwise does not warrant that participation in any programme will produce a particular outcome for any individual or household.

9. Limitation of Liability

To the fullest extent permitted by law, Kinwise will not be liable for any indirect, incidental, or consequential loss arising from your use of the Site or participation in a programme, including any loss of data, opportunity, or goodwill.

Where liability cannot be excluded (for example, under the Consumer Protection Act 1999 or equivalent legislation), our liability is limited to the amount paid by you for the relevant programme.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10. Termination

You may withdraw from a programme in accordance with the cancellation terms in section 6. Kinwise may remove a participant from a programme without refund where their conduct breaches section 4 of these Terms.

Sections 5 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), and 11 (Governing Law) survive termination of this agreement.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from these Terms or your use of Kinwise services shall first be addressed by informal discussion between the parties. If no resolution is reached within 30 days, either party may refer the matter to the courts of Malaysia, with jurisdiction in Kuala Lumpur.

Consumers may also have recourse to the Tribunal for Consumer Claims Malaysia (Tribunal Tuntutan Pengguna Malaysia) for eligible disputes.

12. General Provisions

Entire agreement. These Terms, together with our Privacy Policy and any booking confirmation, constitute the full agreement between you and Kinwise in respect of our services.

Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.

No waiver. Failure by Kinwise to enforce any provision does not constitute a waiver of the right to do so in the future.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. Kinwise may assign or transfer these Terms in connection with a business reorganisation or acquisition.

13. Changes to These Terms

We may update these Terms from time to time. The current version will always be published on this page, with the effective date shown at the top. If you have an active booking at the time of a change, we will notify you directly.

Continued use of the Site or enrolment in a programme after any changes constitute acceptance of the revised Terms.
